PRIVACY & DATA PROTECTION

Privacy notice

Effective 6 November 2026. This notice explains how NakoLive handles personal data and is designed around Botswana’s Data Protection Act, 2024 (Act No. 18 of 2024), which commenced on 14 January 2025.

Applicable law

We aim to follow Botswana’s current data-protection framework. You can consult the Government of Botswana’s access-to-laws service and a summary of the Data Protection Act, 2024. If the law or NakoLive’s processing changes, this notice and the service controls should be reviewed.

Who to contact

Privacy enquiries and data-rights requests can be sent to Info@investate.co.bw, or made by telephone at +267 74043040 or +267 75 350 55. Company website: investate.co.bw.

Information we process

  • Driver account information, including email address and authentication records.
  • Driver registration information: name, telephone number, transport type, vehicle description, number plate and selected routes.
  • Approval or rejection status and administrator feedback.
  • Precise driver location, accuracy, movement status and update time only while an approved driver has location sharing switched on.
  • A passenger’s current or pinned location while finding nearby transport. Precise passenger coordinates are used on the device for matching and are not included in NakoLive’s activity analytics.
  • Limited technical and usage information, such as an anonymous session identifier and actions taken in the app.

Why we use it

We process information to create and secure accounts, verify drivers, display approved available vehicles, recommend nearby transport, operate and improve the service, prevent misuse, respond to requests and meet legal obligations. Precise live driver location is processed only after the driver actively switches sharing on and may be withdrawn by switching it off.

Data protection principles

NakoLive aims to process personal data lawfully, fairly and transparently; use it only for stated purposes; collect only what is necessary; keep it accurate; retain it only as long as needed; and protect it with appropriate technical and organisational safeguards.

Sharing and international processing

Information may be processed by service providers that support authentication, databases, maps, hosting and security, including Supabase, Google Maps and GitHub Pages. Some providers may process data outside Botswana. Where cross-border processing occurs, NakoLive will seek to use appropriate contractual, security and legal safeguards. Opening external directions is subject to Google’s own privacy terms.

Retention

The latest driver position replaces the previous published position. When sharing is switched off, the vehicle is no longer made available to passengers. Account, verification and registration records are retained while needed to operate the account, resolve disputes, protect the service or meet legal obligations. Data that is no longer required should be deleted or anonymised.

Your rights

Subject to applicable law, you may request access to your personal data, correction, deletion, restriction, portability, or object to processing. You may withdraw consent to live location sharing at any time by switching it off. You may also raise a complaint with NakoLive and, where applicable, the Information and Data Protection Commission.

Security and incidents

NakoLive uses access controls, restricted database rules, secure connections and limited collection to reduce risk. No system can guarantee absolute security. Suspected privacy or security incidents should be reported promptly using the contact information above.

Changes to this notice

We may update this notice as the service, regulations or processing activities change. The effective date above will be updated when material changes are made.

This operational privacy notice supports compliance but is not a substitute for an organisation-wide data audit, processor agreements, retention schedule, breach-response plan, staff training or legal advice.
